Reemployment of UC Retired Employees into Staff Positions

If you’ve retired from UC but the university needs your skills, you may be able to return to work for a limited period under certain restrictions. This allows UC to tap the specialized expertise of its retirees, while allowing you to make a valuable contribution to UC’s mission. Because rehired retirees may draw a retirement benefit and another UC income simultaneously, the university must follow clear policy guidelines to ensure public
accountability, transparency and sound succession planning.

Procedures

Step One

For actions within policy, the following documents must be completed and submitted to Judy Abbey in Human Resources at least 30 days in advance of the appointment begin date:

The completed and signed Retired Employees Approvals Form - UBEN 138. Required signatures include the Department Head and Dean/VC/CFAO.
When completing the University Need section, include:
- the purpose/function of the position which fulfills the university need;
- the education, experience and skill the retiree possess; and
- any barriers to filling the position via recruitment.
A copy of the completed UCRP Reemployed Retiree Notification Form - UBEN 1039 must accompany the approvals form for all rehired retirees who are receiving monthly UCRP payments (not required for those who elected to receive a lump sum).
A job description for the position being filled by a retiree.

Step Two

Human Resources will review and forward a recommendation to the Associate Chancellor for final determination.

Step Three

Human Resources will send the final determination to the designated individual within the organizational unit.

Step Four

Rehired Retirees shall not begin a rehired retiree appointment or extension without the final approval from Human Resources, the Associate Chancellor, and if necessary, the Chancellor. Note: Actions that are considered variations from policy (exceptions) are not anticipated, and will require additional justification and approval by the Chancellor.

Additional Information

Effective December 1, 2016, rehired retiree appointments will generally be established with a non-exempt appointment status.
Reemployment beyond 24 cumulative months (except for those rehired into career appointments) will be considered an exception to policy.
If a retiree is to be hired into a career appointment, a recruitment is required and the retiree must suspend their monthly retirement installments (lump sum cash-out retirees cannot be rehired into a career appointment).
UC retirees can be hired as Independent Contractors or Consultants (IC/C) provided this method is not used to circumvent policy. Examples of circumventing the policy include hiring an IC/C UC retiree:
- to do work that is the same/similar to work that is typically done by employees, or
- to do work that is the same or similar to work the UC retiree did at the university prior to retiring.
